If you've spent roughly $5k on a new furnace/heat pump that is
supposed to pay for itself with lower electricity, at what point (how
many repair calls) would the heat pump unit be considered a "lemon"?
We have had the company who installed the Rheem furnace (and 'Weather
King' heat pump - which is a Rheem subsidiary) out about 5 times in the
year since it was installed. Each time the issue turns out to be that
the coolant has leaked out of the unit. The unit actually had this
problem right at the start - there was a crack that was determined to be
a manufacturing defect, and they had to come out within a week or so to
fix that and fill it back up with r412.
Recently I found out that the heat pump hasn't been engaging for some
time. Obviously it wouldn't on the coldest days, (roughly 30F or lower)
but even on the warmer days I saw that it wasn't working. When our
electric bill came in at about $180 more than I was expecting, I sat up
and took notice, and finally realized it wasn't just an issue of the
extra cold winter that was causing the heat pump not to run.
So the guy came out about a week and a half ago, determined that it
was another leak - no coolant left. I asked him at that point when the
company would consider it a lemon, and replace the unit. He laughed,
and said they don't replace them - they just keep sending him out to fix
it. (that was NOT reassuring) He fixed it yesterday, and the 'fix' went
bad in less than 16 hours. No working heat pump today. No fan, despite
it being up near 50 degrees. Nada.
What are my options? Should I just keep putting up with the thing
conking out, and hope they eventually get it right? I'm really starting
to suspect that the thing is really a piece of junk. At this point I
would never recommend that anyone install a Rheem or Weather King heat
pump, due to all of these continuing problems.

What will happen is that they will understand that you are now at a
point where you may become a nuisance (to them!) and the path from a
registered mail to a lawsuit may very well be very short.
If they do not respond, write another letter and threaten a lawsuit.
Another option is to write an open letter in the local newspaper,
describing the issue you have with this heat pump and the company.
No company worth anything will like a negative review. Again, make sure
you can back up the facts!
And also think about BBB, they might be able to help or advice.

I would avoid overtly threatening legal action in the first 2 letters,
and I would avoid threatening legal action indirectly or by implication in
the first one.
Other than that, I would say that the customer is having an ongoing
problem within warranty period and needs this fixed.
Maybe in the 1st letter, if I felt need to get pushy at that point, I
could add, "I look forward to hearing from you how this can be remedied".
In the 2nd letter, I could add, if willing to get "pushy", "I look
forward to hearing from you within xx (maybe 15 or 30) days how this is
going to be remedied".
This appears to me in my experience to often be a polite way,
maybe-semi-"legalese", of "halfway-saying" that "you need to do
this if you know what's good for you".
Important to note in writing: Who you talked with when and how, and
what they did when and how. Have everyone doing work on your property
issue some piece of paper saying what was done, when and who did it,
highly preferably with a company name. Note in your own writing with
date/time somehow anyone who works on your stuff but refuses to be
sufficiently named, refuses to name a company working under, or refuses
to issue a piece of paper saying in some "official manner" what was done
and by who, preferably with a company name.
Subcontractor worker naming subcontractor company is at least fairly OK,
especially if also naming who subcontracted the subcontractor.
Possibly helps if you are in a jurisdiction with licensing requirements
and means for checking out that workers (or their companies) have the
required licenses, and that a licensed worker is at the job site if your
jurisdiction requires that. (Though on the other hand, I see license
requirements being excessive in some jurisdictions for purposes of
"featherbedding").

Note who said what when and quickly, and note who did what and when -
quickly. Be able to tell whoever you communicate with next what was said
and what was done by who.
Ask for name of whoever you are even so much as on the phone with, once
things are even on an early stage of going south. Accept and write down
first-name-only, employee numbers and pseudonyms (with date and time and
any relevant details such as voicemail path) with small-at-most argument
should that be all they offer. Be prepared to write down name or 1st name
if you only get to hear that in the 3rd or 4th second of your phone
conversation should things be someway or another on their way or about to
go downhill.
Some of this may motivate whoever-is-enough-in-charge to get some ball
rolling to *make things right*. This outcome is more likely if your
"tone" and attitude is that what you want is, 1st and 2nd, that your
trouble gets fixed, rather than going to court. It appears to me that
appearing in any way "itching" to go to court, especially to get money
from "them", usualy does not fare well.
Also - know who is responsible for warranty (or lack thereof) for what
items and services you purchased, according to what you got in writing
from whoever is "duly authorized" to issue warranties, and according to
the laws of your jurisdiction. Also, please know well whatever "lemon
laws" apply to your area and your situation and how...

For any new people moving or new to Tucson,
in terms of customer service you will not get much of it
at Fry's Supermarket. Also contrary to their TV spam ads with
there lame CEO that does not answer customer complaints,
their prices are not necessarily cheaper than other chains, in
many cases HIGHER.
Fortunately, in Tucson you have many, many choices.
For the best produce prices, much lower than Fry's or other stores,
try first Food City, then Sunflower Market. Lowest prices on produce
in town. If you're on the South Side there is a new supermarket there
with VERY LOW produce prices, called SUPRA? or similar, right on 6th
Ave.
For the best customer service use Safeway. There prices are higher, but
their meat sale prices are lower than all other stores. Watch out for
their ad small print deceptive practices though.
For deeply discounted organic items, try Grocery Outlet, but be
careful to watch the expiration dates-they like to sell stale stuff.
Also you have Walmart Grocery stores and KMart Grocery stores.
Not to mention Albertsons, Bashas and what other chains I am leaving
out? Basha frequently has the best prices, especially on sale items for
a major chain.
There is no reason to put up with rude employees like you frequently
find at Fry's and unresponsive management that does not answer consumer
complaints. The latest example is the idiot who would not look for extra
stock for me because he was too lazy to stop what he was doing, even
though there was a pallet of product I wanted waiting to be stocked.

So what have you accomplished in 18 years and thousands of people
taking to the streets?
I'm not afraid to ride a big group like that but I highly doubt the
results. My Wisdom of the Jungle tells me not to ride when it amounts
to suicide. I occasionally do it where few others dare, but then I
come back to the Internet where I know I can have a greater impact.
If on the other hand I had a small coordinated group, I'd deliver
results quickly.

CONTINUATION OF OPINION ON CM:
Perhaps I have got it wrong but I assume that the majority of those
who participate in these events imagine that they are somehow
promoting the cause of cycling. No doubt I share their aspirations.
Even so, I deplore their participation in these events.
You have only to look at videos of London events of recent years to
see that they cause obstruction, delay and annoyance to other road
users, which is hardly an intelligent way to win (as the current
jargon has it) the hearts and minds of the wider public. Substantial
numbers of cyclists among those taking part give the clearest possible
impression of being a totally indisciplined and unruly rabble and
there are numerous instances of illegal cycling behaviour. It all
reinforces the already too widespread view of cyclists as having no
respect for other road users, for the rules of the road or for
anything else other than their own selfish agenda.
I have no doubt at all that there are many genuine, respectable and
sincere cyclists on these rides who behave as well as can be expected
given the scale and nature of the events – but as in any large
gathering you will also find the usual suspects, the great unwashed
disaffected and miscellaneous anarchists, few of whom have any real
commitment to whatever cause is supposedly being promoted but they are
there anyway "for a laugh" or to cause trouble if they can. What they
certainly do, like it or not, is undermine the reputation of ALL those
taking part and of the cause itself.
A good ride in the company of other cyclists is a fine thing. So why
not celebrate the best of cycling rather than demonstrate it in such
an unfavourable light? Why not have a proper organising group with
leaders and marshalls and predetermined routes, and official support,
where participants can demonstrate how cycling, even in large numbers,
can be carried out in accordance with the rules of the road and
accomodated with due consideration for other road users in our cities
and towns? This has got to come anyway as more and more people get on
their bikes. Wouldn't it be a marvellous way for cyclists to show that
we are ready for it even if the infrastructure leaves rather a lot to
be desired and that we are willing and able to ride in an orderly and
considerate fashion? Wouldn't that give a much more positive
impression of cycling, and the potential for more cycling, not only to
other road users and casual bystanders at the time but also through
the media coverage to the population at large? Wouldn't this make a
much more beneficial contribution to the debate at national and local
government level about making better provision for cycling?
If cyclists who currently participate in critical mass events cannot
rise to this challenge then I suggest that critical mass in the UK
should be abandoned – for it amounts to nothing more than an
inconsiderate self-indulgence on the part of participants which
offers nothing positive to the cause of cycling.

I rode in *one* CM event. The idea was to ride down one lane of traffic on
a busy lane that had multiple lanes going in both directions. After about
five minutes of this the group leaders changed tactics and started
'counting coup' on cars by circling around them when they were stopped at
a red light. The car they chose had an elderly couple driving a sedan. The
cyclists circled the car, hollering and pounding on the car.
My 20-mile daily commute is on roads for about 15 miles, which I'm not too
worried about because I've selected the route carefully, ride it nearly
every weekday, and have become a defensive rider. But after that CM event?
No more of that - harassing an elderly couple for driving somewhere in a
car? Hell, I'm not in a car more than once or twice a month as a passenger
- the damned things pollute, cost too much, and bust up would could
otherwise be nice quiet neighbors. But the one CM event I participated in
and the others I've seen are narcissistic and adolescent. Maybe there are
some not as confrontational.
